Përveç që është tërësisht jashtë sistemit të drejtësisë së Kosovës, formimi i Dhomave të Specializuara, e që në realitet është një sistem i veçantë i drejtësisë, mund të sjellë gjykim të shtetit të Kosovës.
Gjykimet do të jenë individuale, por Kosova rrezikon të dënohet për gjenocid,

Një prej neneve të projektligjit për Dhomat e Specializuara flet për gjenocidin si vepër penale, e ku sqarohet se kush mund të dënohet për këtë veprim.

Në të përshkruhen të gjitha veprat penale, të cilat mund të rezultojnë me klasifikimin kryerje e gjenocidit,

Njohësit e drejtësisë thonë se politika kosovare duhet ta kundërshtojë me çdo kusht këtë nen dhe të kërkojë heqjen e tij, sepse Kosova, sipas tyre, rrezikon të gjykohet për gjenocid.B inaa
